Agreement to these terms

These Terms and Conditions govern your access to and use of colormodepainting.com and any pages, forms, features, or content on the site, collectively the Site. The Site is operated by Color Mode Painting LLC, a Florida limited liability company, referred to as Color Mode Painting, we, us, or our. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms apply only to the Site. Painting services are governed by the written proposal, work authorization, change order, warranty terms, and other agreement signed by Color Mode Painting and the customer, collectively the Customer Agreement. If these Terms conflict with a Customer Agreement, the Customer Agreement controls for the painting services.

Eligibility and acceptable use

You may use the Site only if you can form a binding contract under applicable law. You agree to provide accurate information and to use the Site only for lawful purposes. You may not:

impersonate another person or misrepresent your authority to request work for a property;
interfere with the Site, probe or bypass security controls, introduce malicious code, scrape the Site through automated means, or place an unreasonable load on the Site;
use Site content or contact information for unauthorized solicitation, infringement, fraud, or any unlawful activity; or
submit sensitive information that we have not requested, such as Social Security numbers, financial-account credentials, or medical information.

Estimate requests and website communications

A website submission is a request for contact or an estimate. It is not an acceptance of work, a binding quote, a reservation of dates, or a Customer Agreement. We may decline a request, request more information, inspect the property, or revise or withdraw preliminary information. Availability, scheduling, scope, measurements, surface conditions, product selection, pricing, and timing remain subject to review and a signed Customer Agreement.

Website descriptions, examples, photos, calculators, price ranges, and other information are general and may not reflect your property. An estimate may change when concealed damage, access limitations, inaccurate information, hazardous materials, substrate conditions, permit requirements, customer changes, or other circumstances affect the work. Nothing on the Site guarantees a particular price, start date, completion date, color result, product availability, or outcome.

Calls texts and email

When you provide a telephone number or email address and submit an estimate or contact request, you authorize Color Mode Painting and service providers acting for us to contact you at the information provided about your request, appointment, estimate, project, or existing customer relationship. Communications may include calls, texts, or emails. Message and data rates may apply. Consent to receive these request-related communications is not consent to receive automated marketing.

Marketing messages are optional. If you separately choose to receive marketing calls or texts, your consent is not a condition of purchasing goods or services. The consent language displayed when you opt in, including whether automated technology or prerecorded messages may be used, controls that program. You may revoke marketing consent by replying STOP to a text or by contacting us at info@colormodepainting.com. We may send one nonpromotional confirmation of a text opt-out. For marketing email, use the unsubscribe link or contact us. We may still send nonmarketing communications that are necessary to respond to a request or administer an existing transaction, as permitted by law.

No professional advice or service contract

Site content is for general informational and promotional purposes. It is not construction, engineering, environmental, legal, insurance, or other professional advice. It does not create a contractor-customer, fiduciary, or other service relationship. Only a Customer Agreement signed by the parties authorizes painting services and states the scope, price, payment terms, warranty, and project-specific obligations.

Intellectual property

The Site and its original text, graphics, photographs, logos, design, and other content are owned by Color Mode Painting or used with permission and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to view and use the Site for your personal, noncommercial evaluation of our services. You may not copy, modify, distribute, sell, license, publish, create derivative works from, or commercially exploit Site content without prior written permission, except as allowed by law.

Color Mode Painting names, logos, and branding may not be used in a way that suggests endorsement or affiliation without written permission. Third-party names and marks belong to their respective owners.

Third party services and links

The Site may link to or use services provided by third parties, including mapping, social media, analytics, advertising, scheduling, hosting, and security providers. Third-party services are governed by their own terms and privacy practices. We do not control and are not responsible for third-party sites, content, availability, or practices. A link does not necessarily imply endorsement.

Site availability and disclaimers

We may change, suspend, or discontinue any part of the Site at any time. We do not promise that the Site will be uninterrupted, error-free, secure, current, or free of harmful components. To the fullest extent permitted by law, the Site and its content are provided as is and as available, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Color Mode Painting LLC and its members, managers, employees, agents, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost data, loss of goodwill, or business interruption, arising from or related to the Site, even if advised that such damages were possible.

To the fullest extent permitted by law, the total liability of Color Mode Painting LLC and the parties listed above for all claims arising from or related to the Site will not exceed the greater of one hundred U.S. dollars or the amount you paid us specifically for use of the Site during the twelve months before the event giving rise to the claim. This limitation concerns the Site only. Liability arising from painting services is governed by the applicable Customer Agreement and law. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Color Mode Painting LLC and its members, managers, employees, and agents from third-party claims, liabilities, damages, judgments, losses, and reasonable costs, including attorneys’ fees, arising from your unlawful use of the Site, your material violation of these Terms, or content you submit that infringes another person’s rights. This obligation does not apply to the extent a claim results from our own negligence, willful misconduct, or violation of law, and it does not alter rights that cannot be waived under applicable law.

Privacy

Our Privacy Policy explains how we collect, use, disclose, and retain information. It is incorporated into these Terms by reference.

Governing law and disputes

Florida law governs these Terms without regard to conflict-of-law principles, except where federal law or another jurisdiction’s nonwaivable law applies. Any judicial action arising solely from use of the Site must be brought in a state or federal court with jurisdiction in the Florida county where Color Mode Painting LLC maintains its principal office. You and Color Mode Painting consent to personal jurisdiction and venue in those courts. This paragraph does not change a dispute provision in a Customer Agreement and does not prevent either party from seeking relief in small claims court when eligible.

Changes to these terms

We may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively when posted unless applicable law requires additional notice or consent. Your continued use of the Site after an update means you accept the revised Terms. The version in effect when you submitted an estimate request will govern that Site interaction, subject to applicable law.

General terms

If a court finds part of these Terms unenforceable, that part will be modified only as much as necessary or severed, and the remaining terms will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a merger, reorganization, sale of assets, or by operation of law. These Terms and the Privacy Policy are the entire agreement concerning use of the Site, but they do not replace a Customer Agreement.
