Scope and summary

 

This Privacy Policy explains how Color Mode Painting LLC, a Florida limited liability company, collects, uses, discloses, and retains personal information through colormodepainting.com, our estimate and contact forms, and related calls, texts, and emails. It does not govern information handled under a separate notice or a signed Customer Agreement to the extent that agreement addresses a specific practice.

We use personal information to respond to requests, prepare and administer estimates and projects, operate and secure the Site, understand Site use, and advertise our services. We do not sell personal information for money. Some analytics and advertising technologies may disclose identifiers and activity to their providers and may be treated as sharing, targeted advertising, or a sale under certain state laws. Your choices are described below.

How we collect information

 

We collect information directly from you when you submit a form, request an estimate, communicate with us, or become a customer. We also collect information automatically through server logs, cookies, pixels, tags, local storage, and similar technologies. Service providers and referral sources may provide information to us when permitted by law.

 

How we use information

 

We may use personal information to:

  • respond to inquiries; schedule appointments; prepare, revise, and follow up on estimates; and communicate about requested or contracted work;
  • verify request details, maintain business records, collect payment under a Customer Agreement, and provide customer service;
  • operate, maintain, personalize, troubleshoot, and improve the Site and our services;
  • measure traffic, evaluate advertising performance, prevent duplicate or fraudulent submissions, and understand how visitors find and use the Site;
  • send marketing communications when permitted by law and consistent with your choices;
  • protect the Site, our customers, and our rights; detect misuse; comply with law; and establish, exercise, or defend legal claims; and
  • carry out a business transaction such as a financing, reorganization, merger, or sale, subject to appropriate safeguards.

 

Estimate request and contact consent

 

Submitting a form authorizes us and providers working for us to use the supplied information to respond to that request by phone, text, or email. Request-related communications may include appointment confirmations, estimate follow-up, schedule changes, and project administration. Message and data rates may apply. This authorization is separate from optional marketing consent.

If we offer marketing calls or texts, we will use a separate, unchecked choice with program-specific disclosures. Agreeing to marketing is not a condition of purchasing services. You may revoke consent through any reasonable method, including replying STOP to a text or emailing info@colormodepainting.com. For marketing emails, use the unsubscribe link or email us. We may retain a suppression record so we can honor the request. An opt-out does not prevent nonmarketing communications permitted by law, including replies to a current request or communications about an existing Customer Agreement.

 

Cookies analytics advertising and Turnstile

 

Cookies and similar technologies help the Site function, remember settings, measure traffic, detect abuse, and evaluate advertising. The tools actually enabled on the Site may change. They may include Google Analytics or Google Ads, which can receive device identifiers, IP address, browser information, Site activity, and advertising or conversion data. Google processes information under its own terms and privacy policies.

The Site may use Cloudflare Turnstile to distinguish legitimate submissions from automated abuse. Turnstile and related Cloudflare services may process device, browser, network, interaction, and security information to provide the verification and protect the Site. Cloudflare processes that information under its own privacy terms. Turnstile is a security tool and is not a guarantee that all fraud or abuse will be prevented.

You can control cookies through browser settings and, if the Site provides one, its cookie-preference tool. Blocking some cookies may affect Site functions. Industry opt-out tools or platform settings may limit certain interest-based advertising but may not stop all advertising or measurement. Where applicable law requires us to recognize an opt-out preference signal, such as Global Privacy Control, we will process the signal as required. We do not currently respond to other browser Do Not Track signals because there is no uniform industry standard.

 

How we disclose information

 

We may disclose personal information to:

  • hosting, form, email, telephone, text-message, scheduling, customer-management, analytics, advertising, payment, document-storage, information-technology, and security providers that support our operations;
  • professional advisers, insurers, auditors, and other parties needed to manage the business or legal matters;
  • government agencies, courts, law enforcement, or other parties when we reasonably believe disclosure is required or permitted by law, needed to protect rights or safety, or necessary to investigate fraud or misuse;
  • a buyer, lender, investor, successor, or other participant in a proposed or completed business transaction; and
  • other parties at your direction or with your consent.

We do not sell personal information for money. As explained above, disclosures through advertising technologies may be classified as sale, sharing, or targeted advertising under some state privacy laws. We do not knowingly sell or share personal information about children under 16 for targeted advertising.

 

Data retention

 

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including responding to requests, maintaining estimate and customer records, providing services, honoring communication preferences, meeting tax, accounting, insurance, warranty, and legal obligations, resolving disputes, and enforcing agreements. Retention periods vary by the type of record, the relationship, and legal requirements. When information is no longer needed, we may delete it, deidentify it, or retain it where law permits or requires.

 

Security

 

We use administrative, technical, and physical measures that we consider reasonable for the nature of the information and our operations. No website, transmission, or storage system is completely secure, and we cannot guarantee absolute security. Please do not submit Social Security numbers, financial-account credentials, medical information, or other sensitive information through a general website form. Florida law may require reasonable security measures and notices after certain breaches; we will address a security incident as applicable law requires.

 

Your choices and privacy rights

 

You may ask us to update or correct contact information, stop marketing, or close an inquiry by contacting info@colormodepainting.com. You may also manage browser cookies and advertising settings as described above.

Depending on where you live and whether a privacy law applies to Color Mode Painting, you may have rights to request access to or a copy of personal information, correction, deletion, or information about our processing; to opt out of sale, sharing, targeted advertising, or certain profiling; to limit certain uses of sensitive information; to withdraw consent; or to appeal a decision. You may also have the right not to receive discriminatory treatment for exercising a privacy right. These rights are subject to definitions, thresholds, exceptions, verification, and other limits in applicable law.

We may ask for information reasonably necessary to verify your identity and authority. An authorized agent may submit a request where allowed by law, but we may require proof of authority and identity verification. We will respond within the period required by applicable law. If we deny an appealable request, our response will explain any available appeal process.

We currently do not offer a standalone Do Not Sell or Share link because we do not sell personal information for money and the applicability of state definitions depends on the Site technologies and the law. Before launch and whenever advertising settings change, the company should confirm whether a consent or opt-out tool and a dedicated link are required. We will honor legally valid opt-out preference signals when required.

 

Florida and other state laws

 

The Florida Digital Bill of Rights applies only to businesses that meet its statutory applicability requirements. Color Mode Painting does not represent in this Policy that the law applies to it. Regardless, this Policy explains our core practices and provides a method for privacy requests. Other state privacy laws, including the California Consumer Privacy Act, also apply only when their respective thresholds and conditions are met. If a law applies, we will provide the rights and notices it requires. Nothing in this Policy limits a nonwaivable right.

 

Children’s privacy

 

The Site is intended for property owners and adults seeking painting services. It is not directed to children under 13, and we do not knowingly collect personal information online from children under 13. If you believe a child provided personal information through the Site, contact us so we can review and, where appropriate, delete it. We do not knowingly use children’s information for targeted advertising.

 

Third party links and services

 

The Site may contain links to third-party websites or services. Their privacy practices are governed by their own notices, not this Policy. Review those notices before providing information. We are not responsible for third-party privacy or security practices.
